The State of Ohio gives you the right to seek treatment from any Ohio Bureau of Workers' Compensation (BWC) certified medical doctor or the chiropractor of your choice (Note: exception for a self-insured employer under the QHP program). In the State of Ohio, there may be restrictions or limits on the types of treatment you can receive relating to your Workers' Compensation Claim Injuries.
In the State of Michigan for the first 28 days following a workplace injury, your employer has the right to choose the doctor he or she wants you to go to for medical care and treatment. Upon the completion of this 28-day period, the employee has the right to seek medical treatment from the doctor of your choosing. To ensure there are no communications or areas of dispute, it is highly advised that you notify your Employer AND the Workers' Compensation Insurance Company in writing, informing them of your decision to change doctors, who the doctor is, the company the doctor works for, as well as the contact information of the doctor that you have chosen to see going forward.
If you have been denied Workers' Compensation Benefits or are being delayed in receiving your Workers' Compensation Benefits, make sure your legal rights are protected.
